Labadieville man convicted of 3rd DWI

A Lafourche jury convicted Sergio Hernandez-Ortiz, 46, of third-offense driving while intoxicated.

The two-day trial stemmed from an incident Nov. 9, 2014, during which the Labadieville man careened into the yard of a home on Talbot Avenue in Thibodaux. He refused to leave, despite the homeowner’s demand he do so, authorities said.

Thibodaux Police confirmed Hernandez-Ortiz’s block alcohol concentration was 25 – three times the legal limit.

“Mr. Hernandez had an opportunity to learn his lesson in 2010 when he plead guilty to two DWIs,” Assistant District Attorney Ben Caillouet said in a release. “Hopefully, this conviction will serve as a wake-up call for him, and in the future he will be more careful and aware of his actions.”

Hernandez-Ortiz’s prior DWI convictions were in 2010; one in Terrebonne, the second in Thibodaux.

He will face sentencing Aug. 19 before District Judge F. Hugh Larose.

Exploitation offender will serve 1 year in prison

A Gheens woman will serve a year in the state penitentiary after pleading guilty to exploiting a handicapped Lafourche woman.

Reba Renee Yates, 28, had been hired in 2014 to provide personal care in the victim’s home, assisting with her daily needs. The woman was a quadriplegic, having suffered a serious spinal-cord injury the year before, according to court documents.

The woman’s family installed a video camera in the home after the woman discovered items missing. Yates was caught on tape stealing money from the victim’s purse.

“I think the felony prison sentence was warranted in this case due to the fact that Reba Yates took a position working as a caregiver in the victim’s home in order to take advantage of a vulnerable Lafourche Parish resident and to steal from her,” Assistant District Attorney Lisa Pinho said.

Pinho prosecuted the case. She specializes in crimes involving victims with physical or mental disabilities.

Yates will serve a year for the crime of exploitation of the infirmed. She also pleaded guilty to a misdemeanor theft charge, and was place on a 2-year probation, ordered to repay $475 and to stay away from the victim.
